Abstract

This study analyzes the crimes of defamation and slander committed through the media in Lebanese law as a form of subsequent censorship of freedom of expression in accordance with the laws of publications, television and radio broadcasting, and the Penal Code. Further, it seeks to deconstruct the legal framework surrounding these offenses, concentrating on the elements of publicity and criminal intent, while emphasizing the judiciary’s role in differentiating between legitimate criticism and criminal defamation. The study also reviews the preventive approach of the Lebanese legislator, which criminalizes a mere act without requiring actual harm, such as attributing a specific incident (blame) or directing insulting expressions (insults). Hence, while the study highlights issues of broad criminalization and unclear discretionary criteria affecting media and digital work, it emphasizes the necessity of updating penal policies to balance personal rights and freedom of expression by minimizing custodial sentences and aligning electronic publishing legislation with constitutional and international standards.
