Abstract

The establishment of a permanent international criminal judiciary with effective powers to prosecute and try perpetrators of international crimes has contributed to the development of the concept of sovereignty. International society has moved from viewing sovereignty as a bulwark that prevents accountability to recognizing the possibility of individuals being subject to judicial prosecution, including heads of state and military leaders. Aspects of the Court’s jurisdiction were regulated by the Rome Statute, which defined crimes within its jurisdiction, including genocide, crimes against humanity, war crimes, and the crime of aggression. The regulations also set the conditions for the convening of this jurisdiction, in terms of the personality of the accused, the place where the crime was committed, and the destination of the referral, whether it is from a state party, which is considered one of the most prominent ways of establishing the case, or pursuant to a Security Council resolution under Chapter Seven. Therefore, the study concludes that it is necessary to work on expanding the mechanisms for initiating criminal cases before the International Criminal Court, particularly with regard to enabling the Public Prosecutor to exercise his powers to initiate cases on his own initiative more effectively.
