Abstract
This research addresses preventive control of spending for economic reasons as a central problem in contemporary labor law, aiming to balance the requirements of freedom of management for the employer with the right to professional and social stability for the employee. The study analyzes the French legal framework, specifically the Employment Protection Plan (PSE), which adopts a proactive approach to mitigate the impact of collective dismissals. This system imposes substantive obligations on employers, such as vocational reintegration, under administrative oversight. Furthermore, the French legislature reinforced this by instituting a penalty of nullity for the absence or deficiency of the plan, rendering compliance a prerequisite for the legality of such dismissals. On the other hand, the research shows the shortcomings of the Lebanese approach, which is limited to prior reporting and consultation with the Ministry of Labor, without establishing integrated legal mechanisms, which undermines the ability to curb random spending. Further, applying a comparative analytical methodology, the study concludes that effective protection hinges on the enforceability of preventive oversight and its associated sanctions. It further asserts that adapting the French model to the Lebanese institutional context would establish a sustainable balance between corporate flexibility and job security.
