Abstract
This research examines the premise that the financial brokerage contract is no longer confined to a traditional representative relationship governed by direct human intent, but has evolved - under digital transformation and artificial intelligence - into a hybrid legal–technical structure. Its core elements and functions are now reshaped through algorithmic integration within intelligent systems, where contractual intent is expressed via pre-programmed digital instructions and performance is intrinsically linked to automated execution. The study underscores that this shift transcends the mere modernization of execution tools, extending instead to the fundamental legal concepts governing the contract, including consent, transparency, and oversight, amid the growing role of algorithmic brokerage subject to automated supervision by international regulatory authorities. Consequently, the research emphasizes that ensuring stability in digital financial markets requires specialized legislative frameworks capable of balancing regulatory control and investor protection with innovation and technological efficiency, alongside the development of a coordinated international regulatory approach reflecting the transnational nature of intelligent brokerage contracts.
