Legal Guarantees for the Integrity of Elections in Democratic Systems (An Analytical Study in Light of the Rule of Law Principle)

Elections derive their legitimacy from their honest expression of the will of voters. Therefore, this study aims to analyze legal guarantees and their role in establishing electoral justice and preventing manipulation. Adopting a critical analytical approach, the study examines legislative texts across the various stages of the electoral process from preparation to appeals, highlighting the integrated roles of the administration, judiciary and civil society in ensuring the integrity of the electoral process. Further, the study concludes that the effectiveness of legal guarantees lies not in their formal existence, but rather in their practical application, the independence of supervisory bodies, and their ability to keep pace with the challenges of technology and political finance. The research also highlights a number of challenges that limit the effectiveness of these guarantees, including weak oversight, political interference, and the ambiguity of some legal texts.
