Abstract

This study examines the effectiveness of the African Union’s membership suspension mechanism as a legal instrument for addressing unconstitutional changes of government. It analyzes the legal framework governing this mechanism and its practical application, focusing on the cases of Mauritania (2008) and Mali (2020–2021) as models to assess its effectiveness. The study concludes that, although the African Union has established an advanced normative framework based on the rejection of coups d’état and unconstitutional changes of government, its implementation remains limited due to political considerations and weak enforcement mechanisms. It also evaluates the role of the Economic Community of West African States (ECOWAS) in managing these crises, while noting that its interventions have not achieved decisive deterrence. The findings underscore the need for a preventive approach that promotes good governance and strengthens institutional stability across the African continent.
