Abstract

This study aims to analyze media crimes in Lebanese law, highlighting the judiciary’s oversight role in addressing their impact on civil peace and public order. It also addresses the legal framework regulating print, visual, and audio media, with a focus on the crimes of media incitement, contempt of religions, inciting sectarian or racist strife, disturbing public peace, and undermining the integrity of the state. Consequently, the study characterizes these acts as endangerment or formal crimes, whereby the legislator penalizes the mere threat to a protected interest, regardless of actual harm, to reinforce a proactive and preventive penal policy. The study also reflects the centrality of the Lebanese judiciary, both judicial and administrative, in balancing freedom of expression with the public system through subsequent judicial oversight of media content. Judicial applications in film censorship embody the judiciary’s consideration of Lebanese social and sectarian privacy when balancing restrictions of expression with legal legitimacy. The study concludes that it is necessary to develop legislation and judicial jurisprudence to keep pace with modern media transformations in a way that enhances the protection of civil peace without compromising the essence of basic rights and freedoms.
