This research addresses the problem of establishing the concept of justice in the context of international criminal law, through an integrated philosophical and legal analysis that reveals the dialectical relationship between justice and international law. It is based on the basic premise that justice is not merely a supreme moral goal, but rather a structural pillar for the stability of the international order and the achievement of international peace and security. Hence, the research is based on an in-depth analysis of the principle of justice within the framework of public international law, explaining how its absence leads to the disintegration of the international social fabric and the growth of a culture of impunity, which threatens the stability of the entire international legal system. This concept is embodied in the principle of legality adopted by the International Criminal Court as a basic guarantee for achieving international criminal justice. The research also traces the development of this concept, moving from the traditional approach to the contemporary concept that focuses on actually reducing the negative effects of international crimes. Accordingly, the study emphasized the role of international criminal justice as a cornerstone in building a robust international legal system based on the rule of law and the protection of human dignity, ensuring the preservation of victims’ rights and preventing the recurrence of atrocities. In addition to achieving the desired balance between ideals and the political and social reality of contemporary international society.
