Abstract

This research examines the role of the administrative judiciary in protecting public rights and freedoms in the modern state, in accordance with the principle of the rule of law, as it represents one of the most essential guarantees for protecting them from the arbitrariness of the authority. However, despite constitutional enshrining of these rights, their effectiveness remains dependent on the existence of an administrative judiciary that enforces respect for the principle of legitimacy and monitors administrative performance. Accordingly, the research highlights that administrative justice is not limited to resolving disputes rather, it contributes to developing judicial precedents and consolidating the principles of justice, which enhances the rule of law and equality for all. It also reviews the legal means of confronting the abuse of power, especially through lawsuits for annulment and compensation. In contrast, the research discusses the challenges that hinder the effectiveness of administrative justice, such as slow litigation, limited capabilities, and the influence of the executive branch, in addition to the emerging challenges posed by electronic administration. The study concludes that strengthening the role of the administrative judiciary requires institutional and legislative reforms and the modernization of its mechanisms to keep pace with modern transformations, thereby ensuring the protection of rights and freedoms and consolidating the rule of law.
